Welcome to Magma! These Terms of Use ("Terms") govern your access to and use of our website (smagma.com) and all related software applications, mobile apps (like Magma VPN), services, documentation, and tools (collectively, the "Services") provided by Magma Security SAS, located at 37 Boulevard Ney, Paris, France.

3. Our Software: Free to Use, Privacy by Design
Magma is committed to providing accessible security tools. Our mobile applications, including Magma VPN, are free to download and use for everyone.
Important Note for Magma Apps (e.g., Magma VPN):
- No User Accounts or Login Required: You do not need to create an account, log in, or provide any personal authentication to use our core applications. This reinforces our commitment to your privacy.
- Open Source Projects: While our main applications (like Magma VPN) are free but not open source, Magma may provide certain other software projects under open-source licenses. For these specific projects, please refer to the individual repository’s license file for detailed terms regarding usage, distribution, and contribution. Your use of these open-source tools is subject to their respective licenses.
4. Intellectual Property Rights
All content and materials available on our website and within our Services—including text, graphics, logos, images, software code, documentation, and the "Magma" brand (collectively, "Magma Content")—are owned by Magma Security SAS or our licensors and are protected by intellectual property laws.
- You may not use our trademarks, logos, or other brand elements without our express prior written permission.
- While you may retain ownership of any content you create and submit to our platform (e.g., bug reports, feedback, if applicable), you grant Magma a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content for the purpose of operating, improving, and promoting the Services.
5. Disclaimers: "As-Is" Service
Our Services are provided to you on an "as-is" and "as available" basis, without any warranties of any kind, either express or implied. While we strive to deliver secure, reliable, and high-performing tools, Magma Security SAS does not guarantee:
- That the Services will be uninterrupted, error-free, or continuously available.

Magma disclaims all liability for any data loss, system damage, or security breaches not directly caused by our gross negligence or willful misconduct. You use the Services at your own sole risk.
6. Limitation of Liability
To the fullest extent permitted by applicable law, Magma Security SAS, its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, data, goodwill, or business opportunities.
- Costs of procuring substitute goods or services.

- Any other intangible losses, resulting from your access to or use of, or inability to access or use, the Services.
In no event shall Magma's total liability to you for all damages, losses, and causes of action exceed the amount of EUR 100. This limitation applies even if Magma has been advised of the possibility of such damages.

Any legal suit, action, or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the competent courts of Paris, France.
